These Terms of Service (“Terms”) govern your purchase and use of products from Tucker Canada, a division of Hicroft Enterprises Inc. (“Tucker,” “we,” “us,” or “our”). By purchasing from us, whether online at www.tuckercanada.com or in-store, you agree to these Terms, as well as our Return & Refund Policy and Privacy Policy. REPRESENTATION

Tucker Canada is an authorzied natinoal distributor for Tucker USA / RHG Products. We distribute Tucker products across Canada but are not the manufactuer and have no control over warranty and products.

Tucker Canada is an authorized Canadian distributor of products manufactured by Tucker USA / RHG Products. Tucker Canada is an independent distributor and is not the manufacturer of the products it sells.

All product designs, specifications, manufacturing processes, warranties, and warranty determinations are the sole responsibility of the manufacturer. Any manufacturer warranty claims are subject to the manufacturer's terms, conditions, inspection processes, and final approval. 

WARRANTIES

All products are covered by the manufacturer’s warranty. Tucker Canada does not provide additional warranties. Warranties are non-transferable. Statutory rights under provincial Sale of Goods Acts remain in effect and are not waived.

If you have a warranty claim please following the process below. Be sure to include pictures and be descriptive.

What Tucker® Warranties:  

Purification Systems: Guaranteed free from manufacturer defects for two years from the purchase date.  All non-wear parts limited to the repair or potential replacement of components on a purification system.  You must have proof of purchase and be the original owner.   

Pole Sections & Clamps: Free from manufacturer defects for life.  

Pumps: Limited one year manufacturer warranty.  
                 *this includes pumps that are part of a Tucker® purification system  

Remotes/Fobs: Limited one year manufacturer warranty. 

All other products EXCEPT water filters: One year from the day you receive them.  

Tucker® Does Not Warranty: filtration components, RO Membranes, DI resin, and all filters.

Manufacturer Warranties Do Not Cover: normal wear and tear, misuse, lack of maintenance or improper handling/neglect of equipment. This also includes custom modifications made after receiving products from Tucker® or damage caused by using parts not produced by Tucker®.  

WARRNATY CLAIM PROCESS:

  1. To start a warranty claim please email: support@tuckercanada.com 
  2. In the Subject Line put: WARRANTY
  3. Please provide the following details:
    • Your Name
    • Your Phone Number
    • Your Order Number (if you have it)
    • The Products you are making a claim on
    • A detailed description of the issue(s), when it happened
    • Pictures of the issue
  4. You will receive a response with next steps within 48 business hours.
  5. Tucker will cover the cost of the replacement part, but the customer will be responsible for shipping costs. *If the item arrives damaged/defective we will pay shipping costs for replacement or repair, but this needs to be identified without delay following the receipt of your product.

RETURNS & REFUNDS

Returns require the original receipt, the product must be unused and in the original box and are subject to restocking fees or exclusions as stated in our policy.

SHIPPING & DELIVERY

Risk of loss and title to products pass to you upon delivery.

Any damage during shipping must be reported to Tucker Canada within 24 hours of delivery.

PAYMENT TERMS

We accept major credit cards, debit, and other methods as listed on our website or in-store. All payments must be authorized and settled before order fulfillment. If an order is cancelled, refunds will be issued to the original payment method less any restocking fees as applicable under this policy.

PRICING ERRORS

In the event of a pricing error, Tucker Canada reserves the right to cancel any order. If your payment has already been processed, you will receive a full refund.

LIMITATION OF LIABILITY

To the maximum extent permitted by law; Tucker Canada is not liable for indirect, incidental, or consequential damages arising from the use of our products or website. Our liability for any claim is limited to the purchase price of the product in question.

INDEMNIFICATION

You agree to indemnify and hold harmless Tucker Canada, Hicroft Enterprises Inc., and our officers, employees, and agents against any claims, losses, damages, or costs (including reasonable legal fees) arising from your misuse of our products, violation of these Terms, or infringement of third-party rights.

INTELLECTUAL PROPERTY

All content on our website and marketing materials is the property of Tucker Canada or Hicroft Enterprises Inc. and is protected by Canadian and U.S. copyright law. You may copy and print content only for placing an order with Tucker Canada. Any other use is prohibited without prior written permission.

GOVERNING LAW

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of that province.

CHANGES TO TERMS

Tucker Canada reserves the right to update these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
